Relentless: Mental Toughness — Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and Relentless App LLC (“Relentless,” “we,” “us,” or “our”) governing your use of the Relentless: Mental Toughness mobile application (the “App”). This document also serves as the End User License Agreement (EULA) for the App.

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms. You may not copy, modify, reverse-engineer, decompile, attempt to extract the source code of, translate, or create derivative works from the App or any part of it. All intellectual property in the App — including content, audio, trademarks, and design — remains our property or that of our licensors.

2. Eligibility

The App is intended for users age 13 and older. If you are under 18, you may use the App only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to keep your device secure. We strongly advise against jailbreaking or rooting your device, which can compromise its security and cause the App to malfunction.

4. Subscriptions, free trial, and billing

The App is offered on a subscription basis with a free trial.

Subscription options. Relentless offers two auto-renewable plans:
- Monthly: $4.99 per month, with a 3-day free trial for new subscribers.
- Annual: $39.99 per year, with a 7-day free trial for new subscribers.
Free trial. If you do not cancel before your trial ends, your subscription begins automatically and you will be charged. If you purchase a subscription while a free trial is active, any unused portion of the trial is forfeited.
Payment. Payment is charged to your Apple ID account upon confirmation of purchase. Relentless does not process or store your payment card details — all payment is handled by Apple.
Auto-renewal. Your subscription renews automatically at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Managing and canceling. You can manage or cancel your subscription at any time in your Apple ID account settings. Deleting the App does not cancel your subscription.
Refunds. Purchases are handled by Apple and are subject to Apple’s refund policies. We do not control and cannot directly issue refunds for App Store purchases.
Price changes. We may change subscription pricing. Where required, we will notify you in advance, and changes will not take effect until your next renewal period.

5. Not medical or mental-health advice

Relentless is a mental-performance and athletic-training app for educational and self-improvement purposes only. It is not a medical device, and it does not provide medical, psychological, psychiatric, or therapeutic advice, diagnosis, or treatment.

The content is not a substitute for professional care from a licensed physician, psychologist, therapist, or other qualified provider.
Do not disregard or delay seeking professional advice because of anything in the App.
The App is not intended for use in a mental-health crisis or emergency. If you are in crisis or may harm yourself or others, contact your local emergency services immediately. In the United States, you can call or text 988 (Suicide & Crisis Lifeline).
Always consult a qualified professional before beginning any new mental, physical, or breathing-based training, particularly if you have a relevant health condition.

You use the App and its exercises at your own risk and are responsible for your own wellbeing.

6. Acceptable use

You agree not to misuse the App, including by attempting to disrupt it, access it through unauthorized means, infringe others’ rights, or use it for any unlawful purpose.

7. Third-party services

The App relies on third-party services that have their own terms and policies, including Apple, Supabase, PostHog, Superwall, and Expo. We are not responsible for the practices of these third parties. Some features require an internet connection; we are not responsible for issues arising from your network, data charges, roaming charges, or a discharged device.

8. Disclaimers

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that results will meet your expectations.

9. Limitation of liability

To the fullest extent permitted by law, Relentless App LLC and its members, officers, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the App. To the fullest extent permitted by law, our total liability for any claim relating to the App will not exceed the amount you paid us in the 12 months before the claim arose.

10. Indemnification

You agree to indemnify and hold harmless Relentless App LLC from any claims, damages, or expenses arising from your misuse of the App or violation of these Terms.

11. Termination

We may suspend or terminate your access to the App at any time, with or without notice, including for violation of these Terms. We may also modify, suspend, or discontinue the App at any time. Upon termination, the rights granted to you under these Terms end and you must stop using the App.

12. Governing law

These Terms are governed by the laws of the State of Kansas, without regard to its conflict-of-laws rules, except where applicable consumer-protection law provides otherwise.

13. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date and post the new version on this page. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
